All services are delivered based on agreed proposals, contracts, or scopes of work.
2. Client Responsibilities
To ensure smooth execution and optimal results, clients agree to:
- Provide accurate and timely information required for campaigns
- Supply necessary access (ad accounts, websites, assets, etc.) where applicable
- Approve creatives, strategies, and materials within reasonable timelines
- Maintain active communication during project execution
Delays caused by lack of client input may affect timelines and performance.
3. Service Results & Expectations
While we aim to deliver strong marketing performance and measurable results:
- We do not guarantee specific outcomes such as sales, revenue, or lead volume unless explicitly stated in a written agreement
- Marketing performance is influenced by multiple factors including market conditions, pricing, product quality, and sales processes
- The client is responsible for handling and converting leads into customers
4. Lead Generation Services (Where Applicable)
For lead generation campaigns:
- Leads are generated through paid advertising platforms and may vary in quality depending on targeting and market conditions
- We strive to provide high-intent and relevant leads based on agreed targeting parameters
- Final qualification and conversion of leads remain the responsibility of the client
5. Payments & Billing
- All fees must be paid as per the agreed proposal or invoice
- Payments are non-refundable unless otherwise stated in writing
- Ad spend budgets (if managed by us) are separate from service fees unless specified
6. Performance-Based or Custom Agreements
Where performance-based models (e.g., “No Sales, No Pay” or revenue share) are agreed:
- Terms will be clearly defined in a separate written agreement
- Tracking methods, reporting structure, and attribution will be mutually agreed
- Any disputes will be handled transparently based on recorded data
7. Intellectual Property
All creatives, campaigns, designs, and materials produced by 10X Creative remain the intellectual property of the agency unless otherwise agreed in writing.
Clients are granted usage rights for active marketing and business purposes.
8. Third-Party Platforms
We work with third-party platforms such as Meta, Google, TikTok, LinkedIn, hosting providers, and analytics tools.
We are not responsible for:
- Platform policy changes or restrictions
- Ad account suspensions or limitations
- Performance fluctuations due to algorithm updates
9. Confidentiality
We maintain strict confidentiality regarding client business data, strategies, and campaign information and do not disclose such information to third parties unless required by law.
10. Limitation of Liability
10X Creative (Pvt) Ltd shall not be held liable for:
- Indirect or consequential losses
- Business losses resulting from market conditions or client-side decisions
- Platform-related disruptions or changes
Our liability is limited to the amount paid for the specific service rendered.
11. Termination
Either party may terminate services with written notice, subject to any active contractual obligations.
Any outstanding payments for completed work remain payable upon termination.
12. Amendments
We reserve the right to update or modify these Terms at any time. Updated versions will be posted on this page with a revised effective date.
